We want you to understand what you are buying and feel comfortable raising a concern. This policy applies with the written scope and Service Terms supplied before you accept an order. It does not remove any cancellation, refund or other right you have under applicable law.

1. Website builds: before payment

For our standard $99, $299 and $499 brochure-website packages, the build fee is due after you approve the finished preview and before launch. There is no upfront build payment.

If you decide not to proceed before paying the standard build fee, tell us, including if you already approved the preview. There is no standard build cancellation fee, and we do not retrospectively charge for preparing the preview. This does not cancel separate work or third-party purchases you expressly authorized and agreed to pay for. We identify any such commitment before it is made. Unpurchased previews are not licensed for live use unless we agree otherwise.

2. If you have paid and change your mind

Contact us promptly before launch or handover if you wish to cancel. Payment follows approval of a custom build, so canceling at that stage does not automatically entitle you to a full refund for completed, approved work. We explain what has been completed and calculate a fair refund for any separable, undelivered work using the agreed scope and price. We do not retrospectively convert a fixed-price project into hourly charges or introduce an unagreed cancellation penalty. We explain the calculation and any disputed amount to you in writing.

After the agreed website has been delivered, a change of preference alone does not normally qualify for a refund. We can discuss changes or additional work. This is different from a website that fails to meet its agreed scope: the next section applies to that situation. Mandatory legal rights always take priority.

3. If our work is wrong or we cannot deliver

If the website or service does not materially match the agreed scope, tell us what is wrong. We will investigate and offer to correct mistakes attributable to our work at no extra charge within a reasonable timeframe agreed with you.

If we cannot complete or correct the affected work within a reasonable time, we will offer a refund appropriate to the undelivered or unusable part. If the failure makes the whole agreed deliverable unusable for its agreed purpose, we will offer a full refund of that deliverable's build fee. A customer does not have to give us repeated unsuccessful repair attempts indefinitely. Rights and remedies provided by law are not limited to this process.

If we cancel a project and cannot provide the agreed deliverable, we refund payments for undelivered work. We will not charge you for an incomplete build you have not agreed to accept. We can agree in writing on usable partial work and a fair price if you wish to keep it.

When a refund affects delivered files or rights, we explain and agree on what the customer may continue using. A partial refund does not automatically remove rights to the separately paid, accepted work. We do not withhold a legally required refund until you waive rights, and we do not remotely delete a live website or take control of a domain as part of an unresolved refund dispute.

4. Canceling monthly website care

The optional $39/month plan renews monthly only after you separately authorize the subscription. There is no long-term contract, cancellation fee or requirement to buy care with a website.

To cancel, email mark@hexmarksystems.com with your business name and a request to stop care. No special form, phone call or reason is required. Where you enroll through an online checkout, we also provide an online subscription-management or cancellation link in your confirmation so you can stop renewal without a phone call. The cancellation channels offered at checkout must remain usable. We may verify that a request is authorized where reasonably necessary, but do not use verification as an unnecessary obstacle to cancellation.

Cancellation stops future renewals. If we receive your request before the next scheduled renewal charge, we will stop that charge even if our confirmation is sent later. If it is charged because we did not process a timely cancellation, we refund that renewal. We send confirmation showing when care ends and whether any refund applies.

Care normally continues until the end of the already-paid monthly period. A used or partly used period is not routinely prorated just because you cancel, except where law requires it. Cancellation does not erase work we already accepted within the paid allowance: we complete it or agree on an appropriate refund. If we fail to provide the agreed care, we offer a correction or an appropriate refund.

For our early-customer offer, if you contact us within seven calendar days of a renewal and we have not performed that period's checks or updates, we will refund that renewal and end care immediately.

Canceling care does not cancel your domain, take away your paid website or require you to buy another service. Domain and other customer-owned subscriptions are separate and remain your responsibility.

5. Canceling pay-as-you-go work

Pay-as-you-go work is $25/hour with a $25 minimum per request, but only after you approve the scope and estimate. Cancel before we begin and there is no labor charge. If work has begun, we charge only for authorized work actually performed, subject to the agreed minimum and spending limit. We explain the time used and refund any advance payment exceeding the amount properly due. Errors in our agreed work are addressed under section 3 rather than charged as new requests.

5A. Other custom services

An automation, integration, diagnostic or other custom engagement has its own agreed milestones and payment schedule. Before starting, the written scope must explain any advance payment, how completed work is valued on cancellation and how an unused balance is returned. The no-upfront standard website offer is not automatically a promise about every custom engagement. We do not begin custom work under an undefined cancellation fee. The correction process, protection against unagreed charges and mandatory rights described here still apply.

6. Domains and other provider charges

Domains, hosting upgrades and other services purchased directly from outside providers are subject to their own cancellation and refund terms. We cannot promise that a domain registration or other provider purchase can be reversed. Before we make an authorized purchase on your behalf, we identify the provider, price, renewal terms and any relevant restrictions.

When we receive a refund from a provider for a charge you funded, we pass it back to you, subject only to any deductions expressly agreed in advance and allowed by law. We remain responsible for addressing errors we made; an outside provider's policy does not remove our own legal obligations.

7. Requesting and receiving a refund

Email mark@hexmarksystems.com with your name, business, payment date or receipt reference, and a short description of the issue. Do not email full card or bank-account details. We will respond to refund requests within five business days; legal response deadlines, where applicable, take priority.

Once a refund is approved, we will submit it to the payment provider within five business days of approval. The time it takes to reach your account depends on the provider and your bank and may be longer. Refunds are normally returned through the original payment method. We will explain any issue that affects timing.

Duplicate or mistaken charges are corrected promptly. You remain free to contact your payment provider, bank or an appropriate authority. Asking us for help does not waive a dispute right or extend a bank's dispute deadline.

8. Questions and changes

Contact Mark Rollin Borja / Hexmark Systems at mark@hexmarksystems.com. If an accepted project has specific refund terms, those must have been clearly agreed before payment and cannot reduce mandatory rights. Later changes to this policy apply prospectively; they do not rewrite the terms of a completed purchase.
